The safest free lease template is one written for your state. Start with your state's official or bar-association resources, then use a free landlord app or forms site that builds a state-specific lease and handles e-signing. We don't publish our own lease template on purpose. A one-size-fits-all lease can include terms that are unenforceable, or even illegal, where your rental is.

This isn't legal advice; lease law varies by state, so check with a local attorney or your state's landlord-tenant resources.

Best for: small landlords who need a lease for a new tenant and want a free, state-appropriate starting point plus a free way to get it signed.

Every link below was checked on October 28, 2026. We haven't used these forms or tools with our own rentals.

Why a generic template is risky

State and city rules decide what a lease must include and what it can't say. Massachusetts is a good example. Its Attorney General's guide says a lease there must give the name, address and phone number of the owner and of the person responsible for maintenance. It must also show any security deposit and explain the tenant's rights to it. The guide lists terms a Massachusetts lease can't contain, including:

  • making the tenant pay for ordinary wear and tear
  • requiring professional cleaning at move-out
  • charging a late fee before rent is 30 days late

A typical generic template found online may break all three.

Some rules apply everywhere. Under federal law, housing built before 1978 needs a lead-based paint disclosure, and the tenant must get the EPA's lead pamphlet. Some cities add their own required attachments. Chicago, for example, requires its Residential Landlord and Tenant Ordinance summary with every lease.

Official and bar-association resources

These come from state governments, attorneys general and bar associations, not from software vendors. Most explain the rules rather than give you a lease to fill in. Florida's bar is the main exception, with free approved lease forms.

If your state isn't listed, search your state attorney general's site or consumer-protection office for "landlord tenant," or use HUD's state-by-state page. For a lawyer, the ABA Lawyer Referral Directory lists bar-run referral services by state. Legal Services Corporation can help you find legal aid if you qualify.

Free lease tools in our directory

If you'd rather have software fill in a state-specific lease and handle signatures, several tools do it for free or cheaply. Prices come from each vendor's site, as listed in our lease e-signature guide and our ezLandlordForms vs eForms comparison.

For most landlords with 1–10 units, Avail's free plan is the simplest free route if it covers your state. It gives you a state-specific lease and e-signing at no cost, and you can collect rent in the same app. If your tenant came through Zillow, Zillow Rental Manager's free lease signing keeps everything in one place.

A free blank template from ezLandlordForms or eForms works if you'll fill it in yourself. In that case, compare it line by line with your state's resources in the table above.

A checklist before anyone signs

This isn't a list of lease clauses. It's a list of things to confirm against your state's resources:

  1. The form matches your state and city. Check required disclosures and any city ordinance attachment, such as Chicago's RLTO summary.
  2. Pre-1978 housing has the federal lead disclosure and the EPA pamphlet.
  3. Deposit terms follow state limits. Check the cap, where the deposit is held, interest and the return deadline.
  4. Fees are allowed. Late fees, application fees and pet fees are capped or banned in some states.
  5. The term and notice periods match state law for fixed-term and month-to-month tenancies.
  6. Everyone gets a signed copy. E-signed leases are generally valid under the federal ESIGN Act and state UETA laws, but a valid signature doesn't fix an unenforceable clause.

If anything is unclear, a one-time review by a local landlord-tenant attorney usually costs less than a dispute.

How we checked

On October 28, 2026, we confirmed that each official link above loads and describes what we say it does. For the Florida Bar forms, we also read the Bar's warning that the forms may not reflect current law. Vendor details come from each vendor's own pricing and help pages, checked the same day for our lease e-signature guide and ezLandlordForms vs eForms comparison. We don't publish lease text, and we haven't used these forms with our own rentals. Some of the vendors run affiliate programs, which played no part in what we list or the order.

FAQ

Is there a free official lease agreement for my state?

Some states have one. The Florida Bar publishes free Supreme Court-approved residential lease forms. Many states only publish guides to the rules, not a lease itself. Check your attorney general's site or HUD's state-by-state page.

Is a free online lease template legally binding?

A signed lease can be binding, but any clause that breaks your state's law may not be enforceable. Massachusetts, for example, bans late fees before rent is 30 days late. Check the template against your state's rules.

What's the best free app for a state-specific lease?

Avail's free plan includes state-specific leases with e-signing. Zillow Rental Manager and Innago offer free e-signing with their templates or your own upload.

Do I need a lead paint disclosure in my lease?

Yes, if the home was built before 1978. Federal rules require a lead-based paint disclosure and the EPA's lead pamphlet for most pre-1978 rental housing.

Can I e-sign a lease for free?

Yes. Avail, Zillow Rental Manager and Innago let you send a lease for e-signing at no cost. See our lease e-signature guide.
